§ 1. General Provisions
1. These Terms specify the rules for using the threedi.pl website, 3D project quoting, and conditions for concluding service and sales agreements for 3D prints.
2. The Threedi.pl website serves an informational, quoting (online calculator), and shared marketing space (platform) purpose for independent contractors. The website does not constitute an offer from a single, registered company.
3. The Seller (and Service Provider) under these Terms, depending on who actually accepts and fulfills a given order, is exclusively one of the following individuals running an unregistered business:
- Rafał Trzaskacz, address: ul. Lazurowa 11, 42-244 Jaskrów, Poland
- Dawid Wojciechowski, address: ul. Edwarda Wittiga 4, 42-209 Częstochowa, Poland
4. Before concluding the contract, the Client is always informed via email which Seller will be responsible for the execution and settlement of their order. Liability for the performance of the contract lies solely with the Seller who concluded the contract with the Client.
5. Common contact address for general inquiries: kontakt@threedi.pl.
§ 2. Electronic Services (3D Calculator)
1. The Website provides a free "Smart 3D Quoting" service, allowing users to upload files (e.g., .STL) to automatically estimate printing costs.
2. The Client uploading the file declares that they hold the copyright or a license allowing its modification and printing. In the event of third-party claims regarding copyright infringement of the uploaded file, the Client bears full financial and legal responsibility and agrees to indemnify the Seller from all liability.
3. The Website reserves the right to refuse printing models that violate Polish law (e.g., firearm parts).
4. Uploaded files are treated as confidential and used solely for quoting and order execution, after which they are deleted.
§ 3. Placing and Fulfilling Orders
1. The quote generated by the online calculator is an estimate and does not constitute a binding commercial offer under the Civil Code. The quote does not include support structures and printing time.
2. The actual contract is concluded when the Client accepts the final quote sent via email by a specific Seller (Rafał Trzaskacz or Dawid Wojciechowski) and makes a payment to the Seller's private bank account indicated in the email.
3. Due to the unregistered business status of the Sellers, the stated prices are gross prices (Sellers are exempt from VAT).
4. Upon the Client's request, a personal proof of purchase (invoice without VAT / receipt) is issued by the Seller fulfilling the order. In accordance with the regulations on unregistered activities, this document is issued to the data of a natural person and does not contain the seller's tax identification number (NIP). Please take this into account for corporate (B2B) orders.
§ 4. No Right of Withdrawal (Important)
1. Pursuant to Art. 38 point 3 of the Consumer Rights Act of May 30, 2014, the right to withdraw from a distance contract (14-day return without giving a reason) does not apply to the Consumer in respect of contracts where the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to satisfy their individualized needs.
2. All 3D prints, CAD designs, and scanning services provided on the platform are personalized, created on individual order from provided files or strict Client guidelines. By law, the right to return does not apply in this case.
§ 5. Non-conformity of goods with the contract and Complaints
1. The Seller fulfilling the order is obliged to deliver an item free from physical and legal defects.
2. If a product defect is found (e.g., printing error, non-compliance with dimensional agreements), the Client has the right to file a complaint.
3. Complaints should be sent to the e-mail address: kontakt@threedi.pl or directly to the e-mail address of the Seller who executed the order.
4. The complaint should include a description of the defect, photos of the defective element, and the Client's request (repair, replacement, price reduction). The Seller will review the complaint within 14 days of its receipt.
5. 3D prints offered by the Seller are of a prototype and hobby nature. Due to the specification of additive technologies, the Seller is not civilly liable for any damages resulting from the use of prints in real conditions (e.g., as structural elements in automotive or industry), unless a separate agreement states otherwise.
§ 6. Final Provisions
1. In matters not covered by these Terms, generally applicable provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
2. The Terms come into effect upon publication on the website.
3. The Consumer has the option of using out-of-court complaint and redress procedures. The online dispute resolution (ODR) platform is available at: http://ec.europa.eu/consumers/odr/.
